Terms of Service

Effective date: 21 January 2026

These Terms of Service ("Terms") govern access to and use of the Clinical Documentation Workspace (the "Service"). The Service is provided as a private MVP / pilot and is intended exclusively for licensed clinicians.

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Scope of the Service

The Service is a browser-based clinical documentation support tool designed to assist clinicians in drafting and organising clinical notes.

The Service:

  • Assists with rewriting and structuring clinician-provided text
  • Supports draft, review, approval, and amendment workflows
  • Maintains patient-centric documentation timelines
  • Provides audit logging and data export functionality

The Service:

  • Does not replace Electronic Health Record (EHR) systems
  • Does not submit data to external clinical systems
  • Does not provide medical advice, diagnoses, or treatment recommendations

2. Intended Users

The Service is intended solely for:

  • Licensed clinicians practising within the European Union
  • Users who are lawfully entitled to process patient data

The Service is not intended for patients, trainees acting independently, or non-clinical users.

3. Clinical Responsibility Disclaimer

The Service is a clinical documentation support tool only.

All content generated by the Service is presented as draft material.

Clinicians remain solely responsible for:

  • Reviewing all generated content
  • Verifying clinical accuracy and completeness
  • Approving documents before use, export, or inclusion in patient records

The Service does not act autonomously and does not replace professional clinical judgment. Clinical responsibility for patient records, decisions, and outcomes remains entirely with the user.

4. AI-Assisted Features

Certain features of the Service use AI-assisted text generation to rewrite and structure clinician-provided notes.

AI-assisted features:

  • Operate strictly on user-provided input
  • Do not generate diagnoses or clinical decisions
  • Do not produce final records without clinician approval

AI-generated content is not persisted as an approved clinical record unless explicitly reviewed and approved by the clinician.

User data is not used to train AI models.

5. Acceptable Use / Fair Use

The Service may be used only for legitimate clinical documentation purposes.

Users must not:

  • Use the Service for unlawful, non-clinical, or inappropriate purposes
  • Share accounts or credentials with unauthorised persons
  • Attempt to bypass security controls, safeguards, rate limits, or audit mechanisms
  • Use automated scripts or tools to extract data at scale
  • Upload data they are not lawfully entitled to process

The Service provider reserves the right to suspend or terminate access where misuse or suspected misuse occurs.

6. Data Protection & GDPR

The Service is designed in accordance with GDPR principles.

Key measures include:

  • EU-only data residency
  • Data minimisation by design
  • Full audit logging of sensitive actions
  • User-accessible data export for access and portability rights

Users act as data controllers for patient data they enter into the Service. The Service provider acts as a data processor. Processing terms are set out in the Data Processing Agreement.

7. Data Retention & Deletion

Users may request deletion of their account and associated data at any time.

Upon account deletion:

  • Active access is revoked
  • Data is deleted or anonymised in accordance with industry-standard retention practices and legal obligations
  • Certain audit records may be retained where required for compliance or security purposes

8. Account Termination

Users may terminate their account at any time.

The Service provider may suspend or terminate accounts where:

  • These Terms are breached
  • Misuse is detected
  • Continued access poses a security or compliance risk

Termination may occur with or without notice depending on severity.

9. Beta Status & Availability

The Service is provided as a private MVP / pilot.

As such:

  • Features may change or be removed
  • Availability is not guaranteed
  • Performance and reliability may vary

The Service is not certified as a medical device.

10. Fees & Payments

The Service is currently provided without charge during the beta period.

Pricing and payment terms may be introduced in the future. Continued use may be subject to acceptance of updated terms.

11. Limitation of Liability

To the maximum extent permitted by law, the Service provider shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.

Nothing in these Terms limits liability where such limitation is prohibited by law.

12. Changes to the Terms

These Terms may be updated from time to time.

Users will be notified of material changes. Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of Ireland.
